Terms of Use
These terms are the agreement between you and Serhii Romanenko, an individual entrepreneur (FOP) registered in Ukraine on 13 July 2020, based in Odesa, Ukraine (“we”), for the Dareboard app and its service. Contact: support@dareboard.app. By using Dareboard you accept them. If you do not accept them, do not use the app.
In short: you must be 18 or older; play with people who agreed to play; subscriptions are bought and managed in the App Store or Google Play; the app is entertainment, provided as it is.
1. Who may use Dareboard
Dareboard is for adults. You must be at least 18 years old, and old enough under the law where you live to enter this agreement. The app asks you to confirm your age when you first open it, and it will not open if your phone says you are under 18.
Some categories contain adult themes. By choosing them you confirm that everyone playing is an adult and has agreed to play them.
2. Licence
We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for private entertainment. The app is licensed, not sold. You may not copy, resell, reverse-engineer, decompile or rebuild the app or its card content, or create derivative works from it, except where the law allows it regardless of this clause.
3. Accounts
You can use part of the app as a guest, without an account. To use a subscription or purchase across devices you sign in with Apple or Google. Keep your sign-in secure and tell us if you suspect misuse.
You can delete your account at any time, in the app or as described at https://dareboard.app/delete-account. Deleting the account does not cancel a subscription.
4. Subscriptions, purchases and refunds
Some features and categories need a paid plan, bought through the App Store or Google Play: a weekly, monthly or yearly subscription, which may begin with a free trial, or a one-time “forever” purchase. The price, the billing period, the length of any free trial and the day charging starts are shown before you buy; prices are those of the store, in your currency, and include taxes where the store adds them.
A subscription renews automatically at the end of each period at the price shown, until you cancel it. If you do not cancel at least 24 hours before a free trial or period ends (or earlier, if the store requires it), you are charged for the next one. You cancel in the store you bought from (App Store or Google Play), not in Dareboard and not by deleting your account; the app has a button that opens the store's subscription settings. Cancelling stops the next renewal; you keep access until the end of the period you paid for. We will tell you in advance if a price change needs your consent, as the store requires.
Payment, billing and refunds are handled by Apple or Google under their own terms, and we cannot refund a store payment ourselves; request a refund from the store (Apple: https://reportaproblem.apple.com; Google Play: https://play.google.com/store/account). The “forever” purchase gives access to the paid content for as long as we offer the app, not for your lifetime.
If you live in the EU, the UK or another place with a statutory right to withdraw from distance purchases within 14 days: by starting a purchase of digital content that is available at once, you ask us to begin supplying it immediately and you acknowledge that you lose the right of withdrawal once it begins, as far as the law allows. This does not affect any refund right the store or the law gives you.
5. Playing responsibly
You are responsible for the people you play with and for what you do in a game. In particular:
- Only type in players who are present and have agreed to be in the game.
- Do not do anything unsafe, illegal or harmful because a card asked you to. Anyone may skip a card at any time, and nobody should be pressured to do a task.
- Do not drink to excess or drive after drinking. Dareboard does not ask anyone to drink; if you play with alcohol, do so only if you are of legal drinking age and drink responsibly.
- Never do anything of a physical or intimate nature with someone who has not clearly agreed to it at that moment. Consent can be withdrawn at any time.
6. Your own tasks
You can add your own tasks. They are text and are used only to run your games. We keep them with your account so they sync between your devices, and erase them when you delete the account. They are yours; you give us only the permission we need to store them and show them back to you. Do not write tasks that harass, humiliate, threaten or discriminate against anyone, that are sexual with or about minors, that are unlawful, or that infringe someone else's rights. You are responsible for them and for showing them to the people you play with.
7. Acceptable use
Do not attack, overload or probe our service, work around the age check or the paid plans, use automated tools to access the service, share your account, or use the app in breach of the law.
8. Content and ownership
The app, its design, its cards and its name belong to us or our licensors and are protected by copyright and trademark law. Dareboard is not affiliated with or endorsed by Apple or Google.
9. Privacy
How we handle personal data is described in the Privacy Policy at https://dareboard.app/privacy.
10. No warranty
Dareboard is entertainment. We provide it “as is” and “as available”, with all faults. We do not promise that it will be uninterrupted or error-free, that it will be available in every country, or that the cards suit every group. Nothing here limits rights you have under mandatory consumer law.
11. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for what happens between the people who play. Our total liability to you for the app is limited to the amount you paid for it in the 12 months before the claim. Nothing limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.
12. Ending the agreement
You may stop using Dareboard at any time. We may suspend or end your access if you break these terms or the law, or if we stop offering the app, in which case we will give reasonable notice and, for a period you have already paid for and cannot use, a refund through the store where possible. Sections that by their nature should survive, survive.
13. Apple App Store terms
If you got Dareboard from the App Store, these additional terms apply, and they prevail over the rest on any conflict:
- This agreement is between you and us only, not Apple. We, not Apple, are responsible for the app and its content. Apple has no obligation to provide maintenance or support for it.
- The licence is limited to a non-transferable licence to use the app on Apple-branded products you own or control, under the Usage Rules in the App Store Terms of Service.
- If the app fails to conform to any warranty that applies, you may tell Apple, which will refund the purchase price; to the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claim, loss, liability, damage, cost or expense from such a failure is our responsibility.
- We, not Apple, are responsible for addressing your claims about the app or your possession and use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of the claim.
- You confirm that you are not located in a country subject to a US government embargo or designated as a terrorist-supporting country, and are not on any US list of prohibited or restricted parties.
- You must comply with applicable third-party terms, such as your mobile carrier's, when using the app.
- Apple and its subsidiaries are third-party beneficiaries of this agreement; on your acceptance, Apple may enforce it against you as a third-party beneficiary.
- Contact for questions, complaints or claims about the app: support@dareboard.app.
If you got Dareboard from Google Play, Google's terms apply to your purchase as described above; Google is not a party to this agreement.
14. Changes
We may update these terms. If a change matters, we will update the date at the top and, where the law requires, tell you in the app before it applies. Continued use after a change means you accept it; if you do not accept it, stop using the app and cancel any subscription.
15. Law and disputes
These terms are governed by the law of Ukraine, without prejudice to the mandatory consumer protection rules of the country where you live. Disputes are for the competent courts of Ukraine, except that if you are a consumer in the EU, the UK or elsewhere with a mandatory right to sue or be sued in your home courts, you may use the courts of your country of residence. Before going to court, please write to support@dareboard.app and give us 30 days to resolve the matter. The EU online dispute resolution platform has been closed; consumers may use their national consumer bodies.
